Q. How do I manage my ad after it is posted?

You'll be able to edit and manage your classified ad by clicking a special link that our server will create and display to you immediately after you post. You will then copy and save, or otherwise safeguard that special link, and then use it to access your Ad Management Page, where you can edit or delete your ad, check its publication status, or manage any picture attachments you may have.

Q. When do Free Ads expire?

Unlike Featured Ads, which are super low-cost ads that are professionally maintained and presented here for consideration above all others, Free Ads are self-service ads which have been provided as a public service on a limited and qualified basis. As such, whenever they are accepted for publication by our staff, Free Ads are self-service ads, which are the sole responsibility of the advertiser to edit, manage, and delete whenever their item sells. So, Free Ads expire whenever the user sells their item, and deletes their ad using the Ad Management Link that is provided to them by our server at the time of posting.

We don't think advertising on the Internet should be like combat fishing. Therefore, repetitive top posting of Free Ads is simply not permitted at Alaska's List. Users are only permitted to post a Free Ad for any item one time. If we decide to publish a Free Ad, we'll take care of keeping that ad in front of our readers until the advertiser decides that they don't need it anymore, and then delete it.

We understand that some things sell right away, and that some things take much longer. After all, how fast an item might sell depends a lot on the [supply & demand] market forces at work with respect to any item or service that is being offered. So, just because an ad has been on the List a long time doesn't mean that it's no longer for sale, and likewise, just because an item has been on the list for only 5 minutes does not mean that it's still for sale.

In our opinion, and in the opinion of over half a million people who have posted ads our site over its 11 plus years of operation, Alaska's List is the most straightforward and hassle-free way to advertise on the Internet.

Gun Section Sales

Because we support your God-given Right to Free Speech, as well as your Right to Keep and Bear Arms, both of which are guaranteed under the Constitution, we do permit firearm and firearm-related advertisements here at Alaska's List. However, we must require that you publish your telephone number in your Gun section ad, and rely on that as your sole means of initial contact with our readers. Therefore, email addresses and the use of our site's Contact Form system is not permitted in Gun section ads.

Web Site Promotion

It has never been our intention to become an Internet search service. Alaska's List is a classifieds site. So, naturally, we want folks who advertise here to provide enough compelling information in their ad to cause our readers to want to call or write to them, and say "Hey! I saw your ad on Alaska's List, and..."

That's what it's all about; making that connection between the reader and the advertiser happen right here at Alaska's List, not somewhere else. This policy is essential, as it helps to ensure that the high value of our service doesn't go unrecognized by our advertisers.

While we do permit links and references to external Wes sites in Featured Ads, provided that the site is exclusively owned by the advertiser, we do not, under any circumstances, permit links or references to competing services, even if such services are owned by the advertiser. Also, we do not permit links of any kind to appear anywhere except at or near the bottom of an ad which contains at least 327 characters of information for the reader's consideration before a link is set out within the ad.

Posting Frequency

We don't believe advertising on the Internet should be like combat fishing, so pursuant to that belief, Alaska's List enforces a strict limit of one ad posting for all unpaid advertisements. After that, if you wish to move your ad to the top of the List, you will be able to do so whenever you buy Featured Ad Time for the ad using the facilities that we provide for doing so on your Ad Management Page. This policy ensures that the value and benefit of our Featured Ads are not diminished for our customers.

Multiple Items in One Ad

If you are offering to sell items separately, then you must advertise those items separately in a separate posting. However, if you are offering multiple things together as a package deal, and as a package deal only, and you offer them that way before you submit your ad, then we may, subject to the sole discretion of Alaska's List, permit you to do so, provided that you must have already included the following two sentences at the bottom your post: "Sold as a package deal only. Will not sell separately" (without the quotation marks, of course). Under all other circumstances, all items must be posted separately, in separate ads.

Individual prices for each items in a package deal ad are also not permitted in package deal ads, since such items are not being offered separately. Also, due to the fact that package deal ads are often changed back to multiple item ads by the user at some point after submission and moderation by our staff, package deal ads may be, subject to the sole discretion of Alaska's List, permanently locked (editing disabled) upon moderation, and the user will not be unable to edit the ad at any point afterward. Consequently, the advertiser will be subject to a nominal $1.89 Deletion Fee in order to have our staff manually remove the ad from the List if the user wishes to remove the ad from the List before it expires.

General Stipulations

Please read this Agreement carefully before accessing the resources provided here at alaskaslist.com, hereinafter referred to as "Alaska's List" or "our Web site." As a condition to, and in consideration for accessing Alaska's List, you agree to be bound by the terms of this Terms of Use Agreement, which include, but are not limited to, all of the provisions set out hereabove and hereafter, the "Agreement." Use of, or access to Alaska's List shall constitute your acceptance of this Agreement and our site's Publication Policies. If you do not wish to be bound by this Agreement, do not access our Web site.

You hereby acknowledge, understand, and agree that this Agreement is entered into by and between Alaska's List and any individual, corporation, association, agency, company, or other entity who accesses or uses our Web site, hereinafter the "User" or "You."

You hereby acknowledge, understand, and agree to act in good faith in your dealings with Alaska's List at all times in the performance performance of your obligations and duties under the Terms of this Agreement and the Publication Policies of our Web site.

You hereby acknowledge, understand, and agree that, in the event that you fail to comply with our Terms of Use Agreement and/or with our site's Publication Policies, or fail to comply with any of the Editorial Directives that we may issue to you with respect to your ad, doing so will be construed as an act of bad faith on your part, which violates the Good Faith Provisions set out within our Terms of Use Agreement; and that any and all payment[s] that you may have made with respect to the ad in question will be summarily forfeited. Violations of our Terms of Use Agreement and/or our site's Publication Policies may also lead to you being permanently being banned from advertising at Alaska's List in the future, depending on the number and severity of such violation[s].

You hereby acknowledge, understand, and agree that all sales are final; and that because Alaska's List is charged a non-refundable fee by its online payment processor for each transaction it processes on our behalf; and the fact that simply allowing you to post on our Web site, and then manually moderating your post in accordance with our Terms of Use Agreement and our site's Publication Policies as we do; and then storing and/or publishing the data contained in that post using our network equipment, constitutes a valuable service that was provided to you which can never be returned to Alaska's List; and that regardless of whether or not Alaska's List ever makes your post viewable by its readers for any length of time thereafter, Alaska's List will never offer nor give you a refund; and that you will never request a refund from Alaska's List, either directly or indirectly at any time subsequent to posting here. The only right with respect to any dissatisfaction you may ever have with the services, policies, guidelines, or practices of Alaska's List is for you to simply discontinue accessing our Web site.

You hereby acknowledge, understand, and agree to access and use Alaska's List only for lawful purposes. You are solely responsible for the knowledge of and adherence to any and all laws, statutes, rules and regulations, pertaining to (i) your use of Alaska's List, including any and all Interactive Areas, (ii) the use of any networks or other services connected to our Web site, and (iii) the communications means by which you connect your computer or any other network device to Alaska's List.

You hereby acknowledge, understand, and agree that Alaska's List is designed to allow users to post classified ads, view classified ads posted by other users, and to interact with each other. Alaska's List contains, or may contain, information, communications, opinions, text, graphics, links, electronic art, animations, audio, video, software, photos, music, sounds and other material and data, hereinafter "our content," which has been formatted, organized and collected in a variety of forms that are generally accessible to Users, including directories and databases, and areas of Alaska's List that can be modified by Users, such as areas for posting and editing ads, uploading files, and responding to user advertisements, hereinafter our "Interactive Areas."

By accessing Alaska's List, ou hereby acknowledge, understand, and agree that you will not: restrict or inhibit any other user from using and enjoying our Interactive Areas; post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or indecent information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law; post or transmit any information, software, or other material which violates or infringes in the rights of others, including material which is an invasion of privacy or publicity rights or which is protected by copyright, trademark or other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or right holder. post or transmit any information, software or other material which contains a virus or other harmful component; alter, damage or delete any our content or other communications that are not your own our content or to otherwise interfere with the ability of others to access Alaska's List; disrupt the normal flow of communication in our Interactive Areas; claim a relationship with or to speak for any business, association, institution or other organization for which you are not authorized to claim such a relationship; violate any operating rule, policy or guideline of your Internet access provider or online service.

You hereby acknowledge, understand, and agree that you may not modify, copy, reproduce, transmit, distribute, publish, create derivative works from, display or otherwise transfer, or commercially exploit any of the our content without the expressed written consent of Alaska's List, in whole or in part. You acknowledge that Alaska's List, its contributors, and/or users remain the owners of our content and that you do not acquire any Intellectual Property Rights by downloading, printing, or diplaying our content in any manner whatsoever.

You hereby acknowledge, understand, and agree that you may upload to any Interactive Area or otherwise transmit, post, publish, reproduce or distribute, on or through Alaska's List only content which is not subject to any Intellectual Property Rights, or content in which any holder of Intellectual Property Rights has given you express authorization for distribution over the Internet and on Alaska's List, without restriction whatsoever. Any content submitted with the consent of a copyright owner other than you should contain a phrase such as "Copyright owned by [owner name]. Used by Permission." By submitting content to any Interactive Area, you automatically grant and/or warrant that the owner of such content, whether it be you, or a third party, has expressly granted to our Web site the royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, sublicense, distribute, perform, and display such content, in whole or in part, worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Intellectual Property Rights that may exist in such content. You also permit Alaska's List to sublicense to third parties the unrestricted right to exercise any of the foregoing rights granted with respect to such content. You also permit any user to access, view, store and reproduce any content you submit for their own personal use insofar as the law may permit.

You hereby acknowledge, understand, and agree that Alaska's List may include various interactive areas. These interactive areas allow feedback to Alaska's List and real-time interaction between users. You further understand that Alaska's List does not control the messages, information, or files delivered to such Interactive Areas, and that neither Alaska's List, nor its partners, nor any of its affiliates, nor their respective directors, officers, employees and agents are responsible for content within any interactive area. Your use of an interactive area will be governed by this Agreement and any additional Policies promulgated by Alaska's List. You agree that Alaska's List has the right to monitor any interactive area, and to disclose any information as necessary to satisfy any Law, regulation or other governmental request, to operate the interactive area, or to protect our Web site and/or its users. If notified of content that is alleged not to conform to this Agreement, Alaska's List may investigate the allegation and determine in its sole discretion whether to remove or request the user to remove such content. Alaska's List reserves the right to prohibit conduct, communication or content within an interactive area, or to edit, refuse to post, or to remove any content, in whole or in part, which it deems in its sole discretion to (i) violate the provisions of this Agreement or any additional Policies promulgated by Alaska's List, which were in effect at that time, (ii) be harmful to the rights of any user, Alaska's List, or other third parties, (iii) violate applicable Law, or (iv) be otherwise objectionable.

You hereby acknowledge, understand, and agree that Alaska's List may, in its sole discretion, remove, edit, suspend, re-classify, or refuse to publish any ad posted at Alaska's List. The only right with respect to dissatisfaction with any policies, guidelines, or practices of Alaska's List in operating Alaska's List, or any change in its content, is for you to discontinue accessing Alaska's List. Alaska's List may terminate or temporarily suspend your access to all or any part of Alaska's List, without notice, for any conduct that Alaska's List believes is a violation of this Agreement or any of its Publication Policies, or for other conduct which Alaska's List believes, in its sole discretion, is harmful to Alaska's List or its Users. Alaska's List may discontinue operating Alaskaslist.com and terminate this Agreement without notice at any time, and for any reason, in its sole discretion. In the event of such termination, you will no longer authorized to access Alaska's List, including our Web site's interactive areas, and the restrictions imposed on you with respect to content downloaded from Alaska's List, as well as the disclaimers and limitations of liabilities and the duties and obligations which have been set forth in this Agreement, shall survive in perpetuity.

You hereby acknowledge, understand, and agree that except for our content, products or services expressly available at Alaska's List, neither Alaska's List, nor or its partners, nor its affiliates, or their respective directors, officers, employees, and agents controls, provides, or is responsible for any content, goods or services available through sites on the Internet which may be linked to or from Alaska's List. All such content, goods and services are made accessible on the Internet by independent third parties and are not part of Alaska's List or controlled by Alaska's List. Alaska's List neither endorses nor is responsible for the accuracy, completeness, usefulness, quality or availability of any content, goods or services available on any site linked to or from Alaska's List, which are the sole responsibility of such independent third parties, and your use thereof is solely at your own risk. Neither Alaska's List, nor its partners, nor its affiliates, or their respective proprietors, employees, and agents shall be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused by your use of or reliance on any content, goods or services available on any site linked to or from Alaska's List or your inability to access the Internet or any site linked to or from Alaska's List.

You hereby acknowledge, understand, and agree that you will use your best judgment in evaluating all information contained or opinions expressed on Alaska's List. It is the policy of Alaska's List not to endorse or oppose any opinion expressed by a user or content provided by a user, contributor, or other independent party. You expressly agree that your use of Alaska's List is at your sole risk. Neither Alaska's List, nor or its partners, nor its affiliates, or their respective proprietors, employees, agents, contractors, affiliates, licensors, or other suppliers providing content, data, information or services warrants that Alaska's List or any Internet site linked to or from Alaska's List will be uninterrupted or error free, that defects will be corrected, or that Alaska's List, including the interactive areas, or the server[s] which make it available, are free of viruses or other harmful components. Nor do any of them make any warranty as to the results that may be obtained from the use of Alaska's List or any Internet site linked to or from Alaska's List or as to the timeliness, sequence, accuracy, authority, completeness, usefulness, noninfringement, reliability, availability, or substance of any content, information, service, or transaction provided through Alaska's List or any site linked to or from Alaska's List. Alaska's List is provided on an "as is," "as available" basis, without warranties of any kind, either express or implied, including, without limitation, those of merchantability and fitness for a particular purpose.

You hereby acknowledge, understand, and agree that under no circumstances shall Alaska's List, or its partners, or its affiliates, or their respective proprietors, employees, agents, contractors, or licensors, be liable for any incidental, special or consequential damages under or arising from this Agreement, whether for breach of contract, tortious behavior, negligence, or under any other cause of action, including without limitation, any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, electrical surge, damage, interference, deletion, defect, delay in operation or transmission, computer virus, communications line failure, breakdown of equipment, software error, infringement, unauthorized access to, or theft, destruction, alteration, or use of records. You specifically acknowledge and agree that Alaska's List is not liable for any defamatory, offensive, fraudulent, or otherwise illegal conduct by any user. If you are dissatisfied with any content at Alaska's List, or with this Agreement, in whole or in part, your sole and exclusive remedy is to discontinue using Alaska's List.

You hereby acknowledge, understand, and agree to indemnify Alaska's List, its partners, and its affiliates, and their respective proprietors, employees, and their agents from any and all liabilities, claims and expenses, including attorneys fees, arising from breach of this Agreement, any other policy, your use or access of Alaska's List or any Internet site linked to or from Alaska's List, or in connection with the transmission of any content on Alaska's List.

You hereby acknowledge, understand, and agree that this Agreement comprises the entire agreement between Alaska's List and you, and supersedes any prior agreements with respect to the subject matter herein. Alaska's List may revise this Agreement or any other Policy at any time, and from time to time without any obligation to provide any notice to you of any kind. You agree to review this Agreement periodically to be aware of such revisions. If any such revision is unacceptable to you, you must discontinue accessing Alaska's List. Your continued accessing and use of Alaska's List following notice of any such revision shall conclusively be deemed acceptance of all such revisions. If any provision of this Agreement or any other policy be held invalid or unenforceable, that portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intention of the parties and the remaining portions will continue in full force and effect. The failure of Alaska's List to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. This Agreement shall be governed by the laws of the state or province of domicile of our Web site, excluding its conflict of laws rules, and you and Alaska's List each submit to the exclusive jurisdiction of the courts of that state. This Agreement is personal to you and you may not assign your rights or obligations hereunder to anyone.

You hereby acknowledge, understand, and agree that all logos, brand names, products, trademarks and service marks appearing herein may be the trademarks or service marks of Alaska's List, or their respective owners. References to any trademark, service mark and links to or from Alaska's List have been done strictly for clarification and identification and does not constitute endorsement by Alaska's List of the products, services or information offered by the owner of such trademark, service mark or link owner.

You hereby acknowledge, understand, and agree that the Publication Policies of our Web site, some of which you hereby acknowledge, understand, and agree may amount to information, including a formula, pattern, compilation, program, device, method, technique, or process which derives independent economic value from not being generally known to, and not being readily ascertainable by other persons who may obtain economic value from its disclosure or use; and that the Publication Policies of our Web site are therefore hereby protected from public disclosure to you or anyone else by the Uniform Trade Secrets Act (UTSA).

You hereby acknowledge, understand, and agree that the content at Alaskaslist.com is provided by Alaska's List, and by individual contributors, third party licensees, and/or other users. You hereby acknowledge that Alaska's List permits access to content which may be protected by copyrights, trademarks, and other proprietary, including intellectual property rights, and that these Intellectual Property Rights are valid and protected in all media existing now or later developed and except as is explicitly provided below, your use of our content shall be governed by applicable copyright and other Intellectual Property Laws. You acknowledge, understand, and agree that, by posting any content at Alaska's List, you grant Alaska's List the royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide right ownership and copyrights to Alaska's List of any and all such content, in perpetuity, until at such time as you delete the posting.

You hereby acknowledge, understand, and agree that Alaska's List will attempt to send you an Ad Management Email when you make a posting at our Web site, and that this email, should it actually be delivered to you by your email service provider, is not an unwanted spam email, but rather a fullfillment email, which permits you to access the Ad Management Page for that individual posting, so that you can manage it in accordance with our Terms of Use Agreement. You also hereby acknowledge, understand, opt-in, and agree to receive these Ad Management Emails from our Web site on a regular basis, and in perpetuity, until at such time as you delete the posting.

You hereby acknowledge, understand, and agree that Alaska's List may send you an Ad Management Text when you first post your ad at our Web site, and that this text is not an unwanted spam, but rather a transactional text, which permits you to access the Ad Management Page for the ad that you posted ad. You also hereby acknowledge, understand, opt-in, and agree to receive these texts from our Web site on a regular basis, and in perpetuity, until at such time as you delete the posting.

You hereby acknowledge, understand, and agree that Alaska's List does not offer free services to anyone; and that our Web site is intended to provide valuable advertising services in return for equitable compensation for those services; and that Alaska's List may sometimes decide to provide free adverting services, on a limited basis, or as a charitable public service, to some users who may qualify for such services under the Publication Policies of our Web site, or as a loss leader; and that when Alaska's List, in its sole discretion, does decide to provide such free services to any user of our Web site, it shall thereafter become the sole responsibility that user to edit, manage, update and dispose of their ad, without any assistance at all from Alaska's List using the Ad Management link that is provided to you by our server on the Posting Success page.

You hereby acknowledge, understand, and agree that, like any business, Alaska's List believes in Free Market Capitalism, which is the exchange of goods or services between parties for their mutual benefit; and that our Web site is, in fact, a celebration of that idea. You also acknowledge, understand, and agree that that Alaska's List rejects every idea of Communism, including the one which proposes that people or businesses are entitled to receive valuable goods and services for free, as well as the notion that people and business are obligated to provide goods and services to others unrewarded; and that we reject those ideas for all of the same reasons anyone else engaged in commerce does -- because the notion of entitlement is antithetical to Capitalism -- the idea that drives all commerce; the theory which motivates people like you to sell your things here on Alaska's List, as opposed to giving them away for free.

You hereby acknowledge, understand, and agree that in the event that you submit a post without purchasing a Featured Ad, that post will be considered by Alaska's List as a request for charity publication of your post on our Web site. However, you hereby acknowledge, understand, and agree that, should you do so, Alaska's List is under no obligation to actually publish the material that you post. You hereby acknowledge, understand, and agree that Alaska's List, when considering your request for charity publication, may require you to provide convincing and verifiable evidence that you genuinely cannot afford paying for our low-cost advertising services. You hereby acknowledge, understand, and agree that, while there are numerous reasons why we will not accept your posting without payment for our services, some or all of which you hereby agree may amount to a Trade Secret, Alaska's List will not, under any circumstances publish a posting by any user for free which exceeds the price limitations that we have been established for each category of our Web site, some or all of which, in our sole discretion, may change from time to time based upon market conditions; and that such price limitations also amount to a Trade Secret which is protected from public disclosure under the Uniform Trade Secrets Act (UTSA).

You hereby acknowledge, understand, and agree to safeguard the Ad Management Link that is provided to you by our server on the Posting Success page which is displayed to you immediately after you post; and to manage your post responsibly, using that link, at all times thereafter; and to delete that post in a timely manner after you have sold the item or service that you were advertising. You also hereby acknowledge, understand, and agree that any unused time that you may have remaining on your ad, if any, after you have sold your item or service, are not transferable to other items or services that you may wish to advertise in its place.

You also hereby acknowledge, understand, and agree that, in the event that you delete your ad, rather than comply with our Terms of Use Agreement, or comply with our Publication Policies, or comply with any of the Editorial Directives that we may issue to you with respect to your ad, doing so will be construed as an act of bad faith on your part, which violates the Good Faith Provisions set out within our Agreement; and that upon doing so, any and all payment[s] that you may have made, if any, which are relevant the ad in question will be forfeited with prejudice; and that any such payments are not transferable to any other posting.

You hereby acknowledge, understand, and agree that when making payments to us via our third party payment processor for a Featured Ad, you will exercise due diligence by ensuring that you only make the number of payments that you intend to make, because whenever you make payments to Alaska's List for a Featured Ad, you do so proactively, of your own volition; and that whenever you may do so, your ad is automatically credited for such payments, thereby increasing the number of days it will be published (its Ad Term). Therefore, whenever you make any payments to Alaska's List via our third party payment processor, whether intentionally or unintentionally, any such payments cannot and will not ever be refunded to you, because you have already agreed herein that all sales are final; and that because Alaska's List is charged a non-refundable fee by our online payment processor for each transaction that they process on our behalf, Alaska's List does not offer or give refunds under any circumstances.
